By accessing our website, creating an account, registering for programmes, purchasing products, or using our services, you acknowledge these Terms & Conditions. Where express acceptance is required, you will be asked to provide it during registration, checkout, or another relevant process.

If you disagree with these Terms & Conditions, please discontinue the relevant service.

  • Digital products, e-books, templates, teaching materials, and downloadable resources.
  • Revision questions, educational articles, journals, and academic resources.
  • School Management Systems and institutional administration solutions.
  • Learning Management Systems and digital teaching platforms.
  • Coding, robotics, and other interactive learning workspaces.
  • Community spaces, discussion forums, professional networking, and directories.
  • Subscription services, memberships, and specialized user portals.
  • Events, appointments, live classes, and virtual consultations.
  • Other educational and digital services introduced through our platform.

Specific products or services may have additional conditions presented before enrollment, purchase, or activation.

3. Eligibility and User Registration

Users must provide accurate, current, and complete information when registering for accounts, programmes, or services.

Users agree to:

  • Maintain accurate registration and contact details.
  • Keep passwords and authentication credentials confidential.
  • Avoid impersonating individuals or organizations.
  • Use accounts only for authorized purposes.
  • Notify us promptly of suspected unauthorized account access.
  • Comply with all applicable laws and platform requirements.

Individuals under 18 must obtain appropriate parental or guardian authorization when required.

Parents, guardians, schools, and other responsible institutions must ensure that minors access appropriate services under suitable supervision.

We may refuse registration or restrict access where eligibility requirements are not satisfied, subject to applicable law.

4. User Accounts and Access to Portals

Bertum Education and Career Hub may provide a unified account through which eligible users access multiple services and portals.

Account permissions depend on assigned roles, subscriptions, institutional affiliation, and service eligibility.

Users may access features intended for students, parents, teachers, instructors, school administrators, institutional representatives, professionals, or customers.

Users must not:

  • Share login credentials with unauthorized individuals.
  • Attempt to access another user’s account.
  • Circumvent role-based restrictions.
  • Manipulate account privileges or subscription permissions.
  • Interfere with the security or normal operation of our systems.

We reserve the right to suspend or restrict accounts involved in unauthorized activities, following appropriate review.

5. Courses, Training and Educational Programmes

Enrollment in our courses or programmes is subject to availability, eligibility, payment requirements, and any stated prerequisites.

Participants are responsible for:

  • Reviewing course descriptions before enrolling.
  • Attending required sessions and completing learning activities.
  • Submitting original work and complying with academic integrity rules.
  • Meeting course-specific deadlines and assessment requirements.
  • Maintaining the necessary devices and internet connectivity.

We may reasonably revise course materials, schedules, instructors, or delivery arrangements when necessary.

Where substantial changes affect a paid programme, affected participants will receive appropriate notification and any remedies required by applicable law.

Course registration and participation are further governed by our Enrollment & Registration Policy.

6. Certificates of Completion

Eligible participants may receive Certificates of Completion after satisfying the requirements of their respective programmes.

Certification requirements may include attendance, assessments, assignments, practical activities, and successful completion of specified learning outcomes.

Unless expressly stated otherwise, Bertum certificates represent completion of the relevant programme and do not constitute government accreditation, professional licensing, or an academic qualification awarded by a recognized examining body.

Recognition of certificates by employers, institutions, professional associations, or other organizations remains subject to their independent requirements.

Certificates may be corrected, withheld, or revoked where there is verified fraud, impersonation, academic misconduct, or an administrative error, subject to appropriate review.

Further conditions are contained in our Training & Certification Policy.

7. Digital Products and Educational Resources

Digital products may include electronic books, downloadable documents, instructional materials, templates, recordings, revision resources, and other educational content.

Unless a product expressly provides different licensing rights, purchases grant a limited, non-exclusive, non-transferable licence for the purchaser’s authorized personal or institutional use.

Users may not:

  • Resell or redistribute digital products without permission.
  • Upload purchased materials to unauthorized sharing platforms.
  • Remove copyright notices or ownership information.
  • Reproduce materials commercially without authorization.
  • Provide access to purchased content beyond the applicable licence.

Digital products remain subject to copyright and intellectual property protections.

Access periods, download limits, compatibility requirements, and licensing restrictions will be communicated where applicable.

8. Pricing, Payments and Billing

Certain services are free, while others require payment or an active subscription.

Prices may vary depending on the service, product, programme, duration, membership level, or institutional requirements.

Before payment, customers should be informed of the applicable price, relevant charges, and material purchase conditions.

Payments may be processed through supported payment gateways, mobile money services, bank transfers, or other authorized methods.

Users agree that:

  • Payment information provided must be accurate and authorized.
  • Access to paid services may depend on successful payment confirmation.
  • Applicable transaction charges will be disclosed where required.
  • Fraudulent payments, unauthorized reversals, and payment manipulation are prohibited.
  • Any installment arrangement must follow its agreed payment schedule.

We may correct genuine pricing or billing errors, with affected customers informed of available options and legal remedies.

Our Pricing & Payments Policy provides further guidance.

9. Subscriptions and Memberships

Subscription-based services may include institutional software, learning platforms, instructor services, premium resources, and membership-based features.

Subscription conditions may specify:

  • Subscription fees and billing periods.
  • Included features and usage limits.
  • Number of eligible users or learners.
  • Subscription activation and expiration dates.
  • Renewal procedures.
  • Applicable cancellation arrangements.

Recurring payments will only apply where the recurring nature of the charge has been disclosed and properly authorized.

Expired or unpaid subscriptions may result in restricted access to paid features, subject to agreed terms and applicable law.

Cancellation generally prevents future subscription charges according to the applicable billing arrangement but does not automatically create entitlement to a refund for services already delivered.

10. School Management and Institutional Platforms

Schools and institutions using our School Management System or other institutional platforms are responsible for ensuring that their authorized users operate the systems appropriately.

Institutional responsibilities include:

  • Providing accurate school and learner information.
  • Assigning appropriate user roles and permissions.
  • Protecting confidential student and staff records.
  • Ensuring lawful collection and use of personal information.
  • Maintaining appropriate parental or guardian authorizations.
  • Preventing unauthorized disclosure of institutional information.
  • Complying with applicable education and data protection requirements.

Institutional information must not be deliberately disclosed to unrelated schools, organizations, or unauthorized users.

Each institution retains responsibility for its lawful control and administration of its records. Bertum’s data protection responsibilities depend on the nature of the service and any applicable institutional agreement.

Where necessary, additional data processing or service agreements will govern the responsibilities of the parties.

11. Instructors, Contributors and Community Participation

Our platforms may permit instructors, authors, educators, professionals, and other approved users to publish educational materials, courses, articles, directory listings, discussions, and other contributions.

Contributors are responsible for ensuring their submissions:

  • Are accurate to the best of their knowledge.
  • Respect intellectual property rights.
  • Do not contain unlawful or harmful material.
  • Do not promote discrimination, harassment, exploitation, or abuse.
  • Do not disclose confidential information without authorization.
  • Comply with applicable publishing and community standards.

Contributors retain ownership of their original materials unless otherwise agreed.

By submitting content for publication, contributors authorize Bertum to host, reproduce, display, and technically process that content as reasonably necessary to operate the selected service.

Separate permission may be required for promotional uses beyond the agreed service.

We may review, moderate, restrict, or remove content that violates applicable rules or legal requirements.

12. Academic Integrity and Responsible Use

We promote ethical learning, responsible research, honesty, and respect for intellectual contributions.

Users must not engage in plagiarism, fabricated research, examination malpractice, impersonation, or unauthorized sharing of confidential assessment materials.

Coding, robotics, and other interactive workspaces must not be used to create malicious software, interfere with computer systems, or undertake unlawful activities.

Violations may lead to removal of content, cancellation of affected results, or restriction of platform access following appropriate review.

13. Child Protection and Safeguarding

Bertum Education and Career Hub supports safe, respectful, and inclusive learning environments.

Users involved in activities with children must protect their dignity, privacy, security, and wellbeing.

Harassment, grooming, exploitation, inappropriate communication, and any form of child abuse are strictly prohibited.

Parents, guardians, instructors, and institutions must comply with applicable child protection requirements.

Suspected safeguarding violations may be reported to relevant authorities where appropriate.

Additional obligations are provided in our Child Safeguarding & Protection Policy.

14. Intellectual Property Rights

Unless otherwise indicated, Bertum Education and Career Hub owns or holds appropriate rights to its original website content, branding, training resources, publications, platform designs, and related intellectual property.

These rights do not extend to third-party materials or user-owned content beyond the rights legitimately granted to Bertum.

Users may not reproduce, commercialize, misrepresent, or unlawfully distribute protected content without permission.

Permitted educational use must comply with applicable licensing conditions and copyright law.

15. Privacy and Personal Data Protection

We respect users’ privacy and are committed to lawful, fair, transparent, and secure handling of personal information.

Personal data may be processed for legitimate purposes including account administration, service delivery, payments, learning activities, institutional operations, communications, and security.

Personal information will be managed in accordance with applicable Kenyan data protection legislation and our published privacy notices.

Users may exercise applicable rights concerning their personal information, including rights relating to access, correction, objection, and deletion, subject to lawful limitations.

Children’s personal information receives additional safeguards where required.

For further details, please consult our Privacy Policy and Data Protection Policy.

16. Refunds, Cancellations and Service Changes

Refunds and cancellations are governed by our published Refund & Cancellation Policy, applicable purchase conditions, and mandatory consumer protection laws.

Refund eligibility may depend on whether a service has commenced, digital content has been accessed, or the relevant cancellation period has expired.

Where eligible, refund requests may be considered for services not yet accessed, qualifying cancellations, or unresolved service delivery failures.

If Bertum cancels a paid programme without providing an agreed alternative, affected customers will be offered an appropriate refund or other lawful remedy.

Nothing in these Terms removes consumer rights that cannot legally be excluded.

17. Third-Party Services and External Links

Our website may integrate with external providers offering payment processing, conferencing, communication, hosting, educational technologies, and other services.

Examples may include Zoom, Google Meet, payment gateways, and external educational resources.

Third-party services may operate under their own terms, privacy policies, and technical requirements.

Bertum is not responsible for independently operated third-party websites or services beyond its legal obligations and the responsibilities it has expressly undertaken.

Users should review relevant third-party conditions before using those services.

18. Service Availability and Technical Limitations

We aim to maintain reliable and accessible digital services.

However, occasional interruptions may occur because of maintenance, software updates, hosting failures, cybersecurity incidents, connectivity problems, or events beyond our reasonable control.

We may temporarily restrict access where necessary to protect users, maintain systems, or resolve technical problems.

Where reasonably practicable, significant planned interruptions will be communicated in advance.

Users experiencing technical difficulties should contact our support team.

19. Disclaimer of Guarantees

Educational resources, training programmes, consultancy services, and digital solutions are intended to support learning, development, and informed decision-making.

Unless expressly guaranteed in writing, participation does not guarantee:

  • Employment or job placement.
  • Admission to a particular institution.
  • Professional registration or accreditation.
  • Specific examination results.
  • Business profitability or career advancement.
  • Universal recognition of a qualification or certificate.

Individual outcomes depend on many factors, including participation, qualifications, circumstances, and independent institutional decisions.

These disclaimers do not limit rights or remedies provided by applicable law.

20. Suspension and Termination

We may investigate suspected violations of these Terms & Conditions.

Depending on the seriousness of the matter, appropriate actions may include warnings, temporary restrictions, content removal, suspension, or account termination.

Immediate protective action may be taken where there is a serious security risk, suspected fraud, unlawful activity, or danger to children or other users.

Users may request account closure, subject to outstanding obligations and applicable record-retention requirements.

Termination does not automatically eliminate lawful payment obligations, intellectual property protections, or other provisions intended to remain effective.

21. Limitation of Liability

To the extent permitted by applicable law, Bertum Education and Career Hub is not responsible for losses caused solely by circumstances outside its reasonable control, misuse of services, or unauthorized actions by third parties for which it is not legally responsible.

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded, including mandatory consumer protections and applicable data protection obligations.

22. Complaints and Dispute Resolution

We encourage users to report concerns through our official communication channels.

Complaints will be reviewed fairly, and we will seek reasonable solutions through communication and, where appropriate, mediation or other lawful procedures.

Users retain the right to pursue applicable statutory remedies and to approach competent regulators or courts.

These Terms are governed by the laws of the Republic of Kenya, subject to any mandatory laws that apply to consumers or users in other jurisdictions.

23. Changes to These Terms

We may update these Terms & Conditions to reflect changes in legislation, services, technology, or operational requirements.

The effective date of the revised Terms will be displayed on this page.

Where a material change affects existing contractual rights, we will provide notice or obtain renewed agreement where required.

Changes will not retroactively remove rights already accrued under applicable law.

24. Related Policies and Agreements

These Terms & Conditions should be read alongside our other applicable policies, including:

  • Privacy Policy and Data Protection Policy.
  • Refund & Cancellation Policy.
  • Pricing & Payments Policy.
  • Enrollment & Registration Policy.
  • Training & Certification Policy.
  • Child Safeguarding & Protection Policy.
  • Copyright & Intellectual Property Policy.
  • Other service-specific agreements and notices.

Where transaction-specific terms have been expressly agreed, they apply to that transaction, subject to mandatory law.
